Do I Need a Mediator to Get Divorced?

If you have concluded that your marriage/ relationship has come to an end with no prospect of reconciliation, you and your ex-partner may choose to work with a mediator to stay in control of the outcomes and avoid court proceedings and litigation.

Mediation is a much cheaper and quicker option for divorcing and separating couples and helps aid better communication and understanding between the parties.

A mediator will support and help you and your ex-partner reach your own informed decisions on all or some of the issues arising out of your breakup by providing key legal and other information and pragmatic guidance on the issues that need to be resolved with the backdrop of the law applicable in mind.

Sometimes, other professionals may be engaged as a third-party neutral to support the process and decision making. For example, a report on pension sharing and divorce would need to be considered if there are substantial pension investments that need to be sorted out and agreed.

If you want a kind, compassionate and dignified divorce, you should opt to work with a mediator. Mediators are skilled and trained to manage conflict, hold space for productive and constructive dialogue and to redress any power imbalances.

Mediation will allow you to keep the bigger picture in mind and will support you and your ex-partner to remain civil and polite to one another. This is particularly important if you have children as you will be able to share space with your child/ren on momentous occasions such as milestone birthdays, special assemblies, sports days, University visits, graduations, engagements, weddings and birth of grandchildren.
